The facts:
I live in Colorado.
I work in an office setting as an account manager.
My office is right next to my boss’ office.
I drink about 128 oz (4 refills of my 32 oz Nalgene bottle) daily while at my desk as I am training for women “figure” bodybuilding competition.
I also have been instructed by my coach to eat every 3 hours for metabolic upkeep.
I work 8-5, M-F.
My boss has officially complained that I use the bathroom too much (about once an hour). And that I get up to eat too often (at 11am and at 3:30pm) – this is not including my hour lunch.Time for prepping meals is 5 minutes each time. (The microwave is my friend).
Being as I work in an office, does the 10 minute break for every 4 hours worked apply to me? Can he technically complain about this??? Isn’t this an OSHA violation?

Thanks for the replies thus far! I have been with this company for years, but have been recently picked on more since I got a promotion and moved my office next to his. When I was out with in cubical-land, I could (as many other do) use the restroom without him noticing. I suspect he is just more aware of me as I have to walk by his office every time I get up, even if it is going to discuss work with a co-worker.
I have not relayed that I am working towards competing but I am sure he is aware as I do leave early once a week for training at a pro gym that is quite a drive. I am a d*mn good worker, so I can’t say that I see his complaints to be anything more than naggy and childish, was simply curious to my rights.
The meals I make are pretty specific and are composed of chicken/tuna/eggs and steamed veggies that I keep in tupperware, pop in the microwave and bring it back to be eaten at my desk. This is a fast process as I don’t spend time lingering around. For arguments sake, we hav

Encouraging anyone to sit at their desk for 7 hours is ridiculous (excluding the 1 hour lunch) and is not humane – not to mention unrealistic in the workplace, period.
He isn’t paying me to train, but I am peeing and eating, I am not doing push-ups at the fax machine.
I read several articles in the newspaper as well as from health/nature organizations and they say that Nalgene bottles are a health hazzard.
Please note, I wash my bottle weekly, sometimes twice in a week. The research articles regarding the Health Hazzards online are the issues I am referring to.
